Was I wrongfully fined and given six points on my license?
I was gonna buy a car from a relative. This car is declared off road and registered in the relatives name. My insurance policy covers me to drive other people’s cars with their permission. So I drove it to an MoT only to be pulled over cos the car came up on the database as uninsured. Before i know it I’m slapped with a 200 pound fine, six points on my license, and the car that doesn’t even belong to me yet has been siezed and locked in the car pound. The previous owner still has the registration document and has not sent it off yet cos as far as they’re concerned the vehicle still belongs to them until I pay them.
Here’s my dilemma. I have already filled out the new keeper details on the V5 registration document, so I’m worried the police may say that means I own the car and was therefore driving uninsured. Does signing the document mean I legally own it? Is it worth me appealing against the way I was treated by the police and getting the fine and points removed?
to be honest its not worth appealing as you were in the wrong. reagrdless of who owns the car you were driving it without a valid mot certificate and valid insurance. Insurance is only valid if the car has mot and tax.
The car should have been towed to the garage or collected on a pick up truck.
You do not legally own the car until the paperwork has been sent to the dvla, however that is not important as you were still driving it, and you were in charge of the vehicle.
sorry to be so blunt. it is just unlucky that a police car caught you driving it.
